Restructuring process (Bankruptcy Code, Article 12 of Law 4013/2011)

Our firm offers integrated services, undertaking all the steps required for the acceptance of applicant companies into the  Restructuring Process provided by the Bankruptcy Code.

More specifically, our experienced team, consisting of Certified Public Accountants, Legal Advisors and Business Consultants undertakes the following:

Stage of preparation of the application for submission to the Court

- The preparation of the Company’s application to the Bankruptcy Court.

-The preparation of the Expert’s report accompanying the application to the Court and which includes:

-A list of the assets and creditors of the Company.

-An Analysis with the possibilities of a successful restructuring of the Company.

-The Expert’s opinion in relation to the financial statements of the Company, the market situation, the viability of the Company, whether the restructuring is not detrimental to the collective satisfaction of the Company’s creditors and whether there is a need for preventive measures according to Article 103 of Law 4013.

Stage that follows the Court's approval

- To act as Mediator, in order to facilitate an agreement of restructuring between the Company and its creditors.

- To undertake the duties of Special Agent(if required), for the performance of specific acts provided by the Court in order to safeguard the property of the Company, the performance of specific managerial operations or the supervision of the execution of the restructuring agreement.
